Brainbay was founded by the NVM to develop products and services for the members of the NVM based on data supplied by the members and non-NVM members, as well as to conduct research into the real estate market.

Data provision to NVM/brainbay

For a number of services, data is also provided to NVM/brainbay. The NVM/brainbay does the following with this data:

  • Ensuring that all NVM estate agents have an up-to-date supply of homes, business premises and agricultural real estate that are or are being offered through NVM estate agents.
  • Ensure that the current offer is placed on funda and other (property) websites.
  • Providing a database that makes appraisals and other valuations possible and insights can be built up about developments in the housing market, commercial real estate market and agricultural real estate market. The data in this database is kept indefinitely.

We take your privacy seriously

The NVM estate agent and NVM/brainbay take your privacy very seriously and see the rules regarding data protection as logical standards of decency. The NVM estate agent processes your data carefully and in accordance with the legal requirements. The NVM broker pays a lot of attention to adequate security so that your data is protected against unauthorized use, unauthorized access, alteration and unlawful destruction. All NVM brokers continuously invest in providing good services. Part of this is the NVM-wide privacy program. If you have any questions, do not hesitate to contact the NVM estate agent.

View, change or delete data

If you would like to know what information the NVM estate agent has on you, please send your request to the estate agent by letter or e-mail.

NVM/brainbay does not process names or other directly identifying data. If you want to know which data NVM/brainbay processes, please also contact the NVM estate agent, who will then ensure that you are informed.

Even if you want to change or delete the data, please send a motivated letter or e-mail to the NVM estate agent. Your request will be granted as soon as possible, unless the law obliges us to keep the data or if there are (other) urgent reasons that oppose change or deletion.

How can you make a complaint?

If you have any questions or if you have a complaint about the use of data by the NVM estate agent, please contact the NVM estate agent first. If you cannot come to an agreement with the NVM estate agent, you can contact the NVM complaints coordinator via: klachtencoordinator@nvm.nl. In that situation, the NVM Data Processing Officer may also consider the complaint. You also have the right to submit a complaint to the Dutch Data Protection Authority.

How long does the NVM broker keep the data?

The NVM broker does not store the data longer than necessary. However, the NVM estate agent retains a number of data for a long time:

  • The NVM estate agent retains a number of data from the services for 20 years, because the NVM estate agent can be held liable for professional errors during this period.
  • The burden of proof that the NVM broker has carried out the mandatory test in the context of the Money Laundering and Terrorist Financing Prevention Act (Wwft) is retained by the NVM broker for 5 years.

You sell your home and you have engaged the NVM estate agent for this

The purpose of this contact is to promote your home on your behalf, to gain insight into the value of and interest in your home, to arrange viewings and to negotiate on your behalf and to supervise the transaction. The NVM estate agent also establishes your identity. You may also be approached for an estate agent assessment and you will receive sales statistics from funda. The following data can be processed:

Data use by the NVM/brainbay

The NVM broker provides certain information to the NVM/brainbay via a link.

NVM/brainbay is the data controller for the data received. The NVM/brainbay does the following with this data:

  1. Ensuring that all NVM estate agents have an up-to-date supply of homes, business premises and agricultural real estate that are or are being offered through NVM estate agents.
  2. Ensure that the current offer is placed on Funda and other (property) websites.
  3. Providing a database that makes appraisals and other valuations possible and insights can be built up about developments in the housing market, commercial real estate market and the agricultural real estate market.

A. Current offer of homes, commercial properties and agricultural real estate at NVM brokers

If you want to sell/let a home, business premises or agricultural holdings through an NVM estate agent, the following information will be disclosed to other NVM estate agents:

  • The address of the home, commercial premises or agricultural holdings, the description and characteristics of the object such as the asking price, the year of construction, the surfaces and layout, cadastral data, WOZ value and photos of the object.
  • Date the object comes on the market, date the object is taken off the market. Sale subject to change, date of sale and transaction price.

This data is used by NVM estate agents to provide services to their customers (seekers of a home, business premises or agricultural real estate).

This data is kept indefinitely in connection with the database with historical offers, see under C.

B. Current offer of homes, commercial properties and agricultural real estate on (home) websites, including Funda

If you want to sell/rent a home, commercial premises or agricultural holdings through an NVM estate agent, they can also disclose information to Funda and other (house) websites in consultation with you. This concerns the following data:

  • The address of the home, commercial premises or agricultural holdings, the description and characteristics of the object such as the asking price, the year of construction, the surfaces and layout, cadastral data, WOZ value and photos of the object.
  • Date the object comes on the market, date of sale.

With this information, your object is brought to the attention of consumers, professional parties and/or third parties who search themselves via (home) websites.

This data may still be visible on these websites for a maximum of one year after the date of sale or the date on which a home, commercial property or agricultural holding is taken off the market.

C. Database with historical offerings

The following data is recorded in the NVM database for all homes, business premises and agricultural real estate that are offered for sale or rent through an NVM estate agent:

  • The address of the home, commercial premises or agricultural holdings, the description and characteristics of the object such as the asking price, the year of construction, the surfaces and layout, cadastral data, WOZ value and photos of the object.
  • Date the object comes on the market, date the object is taken off the market. Sale subject to change, transaction date and transaction price.
  • The postal code (1234AB) and house number of the buyer’s previous (residential) address.

The aforementioned data will be kept indefinitely.

With the aforementioned data, brainbay enables analyzes of the real estate market on behalf of the NVM.

The NVM/brainbay also provides this information to selected third parties, namely:

  • NVM appraisers, for making appraisals and other valuations.
  • Validation institutes, after explicit instructions from an NVM valuer, for checking valuation reports.
  • Municipalities, for determining WOZ values.
  • The Ministry of Infrastructure and Water Management, for research into the housing market.
  • Universities, for research purposes.
  • NVM brokers in the context of providing services to their clients.
  • Non-NVM brokers, banks, project developers and housing associations, for research purposes (e.g. housing demand in a specific region).

These parties only have access to data for the stated purposes and where possible, data is only provided at an aggregated level.

Internal audits and investigations

The NVM may view your data when it conducts research among its members to determine whether the rules are being complied with and when an NVM member audits an NVM member. After inspection, this data will no longer be processed by the NVM.

View, change or delete data

If you would like to view, change or delete the data processed at NVM/brainbay, please contact the NVM via privacyhelpdesk@nvm.nl. The NVM will assess whether you are entitled to submit the request and then whether your request will be granted.
